By visiting, registering or accepting an Order on the Platform Coach acknowledges having read, understood, agreed to these Terms of Service for Coaches (hereinafter referred to as the “Terms”) and agrees to be legally bound by them.
1.1 These Terms apply to any Order undertaken by you as a Coach and regulate all processes related to it. They apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by law, trade custom, practice or course of dealing.
1.2 We reserve the right to make changes to the Terms at any time. You agree to be bound by any variation made by us variation of the Terms. If you do not agree with the new Terms, you must stop using the Platform immediately.
1.3 Terms are only available in English. In case of any translation of the Terms the English version shall prevail.
1.4 Your use of the Platform is governed by our General Terms and Conditions. .
2.1. All capitalized terms used herein and not otherwise defined in these Terms will have the meaning set forth in General Terms and Conditions. .
3.1 The Platform provides the Coaches with the non-exclusive license which gives the Coaches access to the Platform’s functionality allowing them to proceed with the selection of the Orders and communication with the Customers in connection with the provision of the Services.
3.2 These Terms are the entire agreement between you and us in relation to the subject matter of the provided non-exclusive license. You acknowledge that you have not relied on any statement, promise or representation or assurance or warranty that is not set out in the Terms.
4.1 In order to become a Coach, you shall take the following actions:
4.1.1. Register on the Platform by clicking the button “sign up” in the upper right corner of the website ;
4.1.2. Successfully complete an interview with the manager of the Platform;
4.1.3. Provide the manager of the Platform with the profile statistics of the game on which you want to be a Coach;
4.1.4. Accept the Rules ; which are an integral part of the Terms of Services for Coaches;
4.1.5. Complete the test Order.
4.2 Only when all the steps under clause 4.1 of these Terms are completed, will you be able to proceed with the provision of the Services.
5.1 As soon as you become a Coach, the list of Orders placed by users will become available to you.
5.2 If you want to accept an Order, you need to click “Get an order”. The Order will be taken by the Coach who fully accepts the Order first.
5.3 If you are the first one who accepted the Order, you will receive an Order confirmation via email to the email address which you had specified during your registration on the Platform.
5.4 After the Order is confirmed, you will be able to chat with the Customer.
6.1 The Services have to be provided in accordance with the Customers’ requirements and the requirements of the Platform set out in the article 5 of the Rules . The quality of the Services should fully meet all reasonable demands of the Customer.
6.2 There is no minimum possible deadline for fulfillment of an Order. The exact deadline is agreed upon between the Customer and the support manager before or after the payment for the Order is made.
7.1 As soon as the Coach completes the Order, the Coach shall download the confirmation (screenshot(s) and/or a video) of the provided Services. The confirmation has to be downloaded before the end of the deadline.
7.2 The screenshot or the video of the completed Order shall be considered as the relevant confirmation of the Services’ provision in the case of any dispute.
7.3 As soon as the Coach downloads the confirmation, the Platform’s manager will proceed with confirming the completed Orders’ compliance with the Customer’s requirements. The manager has to complete the check within 48 hours from the moment the Order is downloaded by the Coach.
7.4 If the manager concludes that a) the Order complies with the requirements pointed out under the article 6 of the Terms and b) the Coach provided relevant confirmation(s) of the performance of the Order, the Order’s status will change to “Completed” and the Customer shall receive notification via the email address which was provided during the registration.
7.5 In case the Order is partially completed, the Order does not comply with the Customer’s requirements or the Coach doesn’t provide the Platform with the good quality confirmation of the performance of the Order, the Platform may return the Order to the Coach for completion or withdraw the Order without any renumeration. 8.1 If the Customer is dissatisfied with the quality of the provided Services, the Customer may request changes or a reduction in the price.
8.2 Any revisions requested by the Customer under the Warranty Period must fall within the initial instructions for the Order.
8.3 In case the completed Order does not meet the initial requirements of the Customer, the Customer may refuse to accept the Order.
8.4 The Warranty Period’s duration depends on the type of the Service and the status of the Coach:
8.5 The Order is considered to be completed and the Coaches’ obligations are considered to be fulfilled upon the Warranty Period’s expiration. In the case that the Warranty is not provided the Order should be considered to be completed at the moment of giving the status «done» to the Order.
9.1 Refusal to perform the Order. In case the Coach refuses to perform the Order without a reasonably valid reason (i.e. lack of Customer’s response, a mistake with the ordering on the Platform’s side or any other reasons), the Coach will be liable to pay liquidated damages up to the total amount of the Order.
9.2 Asking for Platform’s assistance with the solution of the disputes with the Customer. In case you have reasonable remarks and complaints about requests of the Customer, you shall be entitled to ask for the Platform’s assistance with the settlement of the dispute. If the Coach and the Customer cannot reach an arrangement, the Coach may refuse to perform the Order. The manager of the Platform will suggest the Customer another Coach to perform an Order (this notwithstanding Customer’s right to cancel an Order), while the Coach will be suggested to chose another Order for performance. In case that the Customer realizes the options to change the Coach or cancels the Order because of the Coach’s disrespectful attitude towards the Customer, the Platform has the right to fine the Coach in the amount of USD 10.
9.3 Additional Sale. If the Customer is satisfied with the provision of the Services, the Coach may offer any additional Services in accordance with the Customer’s needs. If the Customer accepts the Coach’s Offer, the Coach should ask the Platform to proceed with the generation of the Order. The Coach receives from the Platform a guarantee that he will perform this additional Order.
10.1 Prices for the Services are notified to you and accepted by you within the context of the familiarization with the Orders available for the performance. All prices are in USD and include VAT at the applicable rate.
11.1 The Coach is entitled to withdraw the renumeration at the moment of expiration of the Warranty Period. In the case that the Warranty Period is not provided the Coach is entitled to withdraw the renumeration at the moment of giving the status «done» to the Order.
11.2 In case of a refund and/or any claim from the Customer we would refrain from making any payment and/or may request a refund from you of any amounts returned to the Customer.
11.3 You are solely responsible for the payment of the payment systems’ commissions related to the funds’ withdrawal. The amount of the commission depends on the withdrawal method. The maximum commission is 500 USD per 1 transaction.
11.4 The withdrawal application will be completed within 2 working days from the application’s date.
